Positions Dance Studio, doing business as Positions Dance Studio, is committed to protecting the privacy of individuals who participate in the Position Dance Studio VIP Rewards loyalty and SMS marketing program (the "Program"). The Program is powered by Stick SMS & Marketing Platform ("Stick"), which provides the technology infrastructure and SMS delivery services on our behalf.

This Privacy Policy explains how we collect, use, disclose, and protect your personal information when you enrol in or use the Program. By scanning our QR code and enrolling, you acknowledge that you have read and understood this Privacy Policy and agree to the practices described herein. If you do not agree, please do not enrol.

This Privacy Policy applies to residents of the United States only.

1. Information We Collect

We collect personal information from you directly, through your use of the Program, and in some cases from third parties. The categories of information we collect include:

1.1 Information You Provide

  • Mobile telephone number: collected at enrolment when you scan our QR code and complete the sign-up process.

  • Name: if voluntarily provided during enrolment or in subsequent interactions with the Program.

  • Email address: if voluntarily provided during enrolment or for account communications.

  • Any other information you choose to submit when contacting us for support.

1.2 Information Collected Automatically

  • Participation data: records of points earned, rewards redeemed, and visit frequency associated with your mobile number.

  • Message interaction data: whether you received, opened, or responded to SMS messages (to the extent technically available).

  • Opt-out and opt-in history: records of your consent status and any changes to your communication preferences.

  • Date and time of enrolment and programme activity.

1.3 Information from Visits

We or our staff may record additional information related to your transactions or visits at Positions Dance Studio, such as purchase amounts or visit frequency, in order to administer the loyalty Program. This information is used solely to support the Program features we offer.

1.4 Technical Information

When you interact with any web-based component of the Program (such as a landing page or QR code scan redirect), we may automatically collect technical information including your device type, operating system, browser type, and IP address. This information is used for security and service improvement purposes only.

2. How We Use Your Information

We use the personal information we collect for the following purposes:

2.1 To Operate the Program

  • To enrol you in and administer your loyalty rewards account;

  • To track and credit your points and reward redemptions;

  • To send you Program-related SMS messages as described in Section 4;

  • To process opt-out requests and maintain your communication preferences;

  • To provide customer support.

2.2 To Improve Our Services

  • To analyse Program usage and performance in aggregate, anonymised form;

  • To diagnose technical issues and improve our delivery of the Program;

  • To develop new Program features and rewards.

2.3 Legal and Compliance

  • To comply with applicable laws and regulations, including the Telephone Consumer Protection Act (TCPA) and applicable state laws;

  • To enforce our Terms & Conditions;

  • To protect the rights, property, and safety of us, Program participants, and the public.

We do not use your personal information to make automated decisions that significantly affect you, and we do not use it for purposes other than those described in this Privacy Policy without your consent.

3. Legal Basis for Processing

Where required by applicable law, we rely on the following legal bases for processing your personal information:

  • Consent: your express written consent provided when you enrol in the Program by scanning our QR code and completing sign-up, particularly for sending marketing SMS messages.

  • Contract performance: processing necessary to fulfil our obligations under the Program Terms & Conditions.

  • Legitimate interests: processing necessary for our legitimate business interests, such as improving the Program and preventing fraud, where these interests are not overridden by your privacy rights.

  • Legal obligation: processing required to comply with applicable law.

4. SMS Communications & TCPA Compliance

By enrolling in the Program, you provide your express written consent to receive recurring automated marketing and transactional text messages (SMS and MMS) from us at the mobile number you provided. Your consent is not a condition of any purchase.

Opt-out: You may opt out at any time by replying STOP to any message, or by texting STOP to 18336311609. You will receive a final confirmation text and no further marketing messages from our Program.

Message frequency: Varies. Standard message and data rates from your mobile carrier may apply.

We maintain records of all consents, opt-out requests, and communication preferences in compliance with TCPA requirements and applicable carrier guidelines, including A2P 10DLC registration requirements. These records are maintained by Stick on our behalf as technology service provider.

5. How We Share Your Information

We do not sell, rent, or trade your personal information to third parties for their own marketing purposes. We may share your information in the following limited circumstances:

5.1 With Our Technology Service Provider

Stick SMS & Marketing Platform processes your personal information on our behalf as a service provider to deliver the Program's technology features — including SMS delivery, loyalty points tracking, and QR code enrolment. Stick is contractually bound to process your information only as directed by Positions Dance Studio and to maintain appropriate data security standards. Stick does not use your personal information for its own marketing purposes.

5.2 For Business Operations

We may share your information with carefully selected third-party vendors who assist us in operating the Program, such as cloud hosting providers and analytics tools. These providers are permitted to use your information only as necessary to provide services to us.

5.3 For Legal Compliance

We may disclose your information if required by law, regulation, court order, or other legal process, or if we believe in good faith that such disclosure is necessary to: (a) comply with a legal obligation; (b) protect the rights or property of our business; (c) prevent or investigate possible wrongdoing; or (d) protect the personal safety of users or the public.

5.4 Business Transfers

In the event of a merger, acquisition, reorganisation, or sale of assets involving Positions Dance Studio, your information may be transferred to a successor entity as part of that transaction. We will notify you of any such change in ownership or control of your personal information.

6. Data Retention

We retain your personal information for as long as necessary to provide the Program services and to comply with our legal obligations. Specifically:

  • Active account data (mobile number, points balance, participation history) is retained for as long as you are an active Program participant.

  • If you opt out of the Program, we will retain a record of your opt-out for a minimum of four (4) years to comply with TCPA suppression list requirements.

  • SMS consent and communication records are retained for a minimum of four (4) years.

  • Aggregated, anonymised analytics data may be retained indefinitely.

Upon your verified request to delete your personal data (see Section 7), we will delete or anonymise your information, except where retention is required by law.

7. Your Rights & Choices

Depending on your location, you may have certain rights with respect to your personal information:

7.1 Opt Out of SMS Marketing

You may opt out of receiving marketing text messages at any time by replying STOP to any Program message, or by texting STOP to 18336311609. Opting out of marketing messages will not affect our ability to send you a final confirmation of your opt-out.

7.2 Access & Correction

You may request access to the personal information we hold about you and request correction of any inaccurate information by contacting us at kelly@positionsstudio.com or 6316698612.

7.3 Deletion

You may request deletion of your personal information by contacting us. We will fulfil deletion requests subject to our legal obligation to retain certain records (e.g., opt-out suppression lists for TCPA compliance). Following a verified deletion request, we will delete or anonymise your information within thirty (30) days.

7.4 California Residents — CCPA/CPRA Rights

If you are a California resident, you have the following additional rights under the California Consumer Privacy Act (CCPA) and California Privacy Rights Act (CPRA):

  • The right to know what personal information we collect, use, disclose, and sell;

  • The right to delete your personal information, subject to certain exceptions;

  • The right to opt out of the sale or sharing of your personal information (note: we do not sell personal information);

  • The right to non-discrimination for exercising your CCPA/CPRA rights;

  • The right to correct inaccurate personal information.

7.5 Other State Privacy Rights

Residents of Virginia, Colorado, Connecticut, Texas, Utah, and other states with comprehensive privacy laws may have additional rights, including the right to access, correct, delete, and port their personal information, and to opt out of certain processing activities. Please contact us to exercise your rights under applicable state law.

8. Children's Privacy

  • The Program is not directed to individuals under the age of 13.

We do not knowingly collect personal information from minors below the applicable minimum age without verifiable parental consent. If you believe we may have inadvertently collected information from an underage individual, please contact us immediately using the details in Section 11 so we can delete that information promptly.

We do not knowingly collect personal information from children under the age of 13 (COPPA). Any such information collected inadvertently will be deleted upon discovery.

9. Cookies & Tracking Technologies

Any web-based components of the Program (such as enrolment landing pages accessible via QR code) may use cookies, web beacons, and similar technologies to provide functionality, analyse usage, and improve the user experience. Essential cookies required for the Platform to function cannot be disabled. Where required by law, we will seek your consent before deploying non-essential cookies.

We do not use tracking technologies to build advertising profiles or track you across unaffiliated third-party websites.

10. Data Security

We implement and maintain commercially reasonable technical and organisational security measures to protect your personal information from unauthorised access, disclosure, alteration, or destruction. Our technology provider, Stick, maintains security standards including encryption of data in transit (TLS), access controls, and regular security assessments.

No method of transmission over the internet or method of electronic storage is completely secure. While we strive to protect your personal information, we cannot guarantee absolute security. In the event of a data breach that is likely to affect your rights and freedoms, we will notify you and relevant authorities as required by applicable law.

SMS messages or Program communications may occasionally include links to third-party websites or resources. We are not responsible for the privacy practices or content of those third-party sites. We encourage you to review the privacy policies of any third-party sites you visit.

13. Changes to This Privacy Policy

We may update this Privacy Policy from time to time to reflect changes in our practices, technology, legal requirements, or for other operational reasons. When we make material changes, we will notify enrolled Program participants by sending an SMS notification.

Your continued participation in the Program following notice of any changes constitutes your acceptance of the updated Privacy Policy. If you do not agree to the revised Policy, please opt out of the Program by replying STOP to any message.
