Positions Dance Studio Loyalty & SMS Program

Powered by Stick SMS & Marketing Platform

These Terms and Conditions ("Terms") govern your participation in the Position Dance Studio VIP Rewards loyalty and SMS marketing program (the "Program") operated by Positions Dance Studio, doing business as Positions Dance Studio ("we", "us", or "our"). The Program is powered by Stick SMS & Marketing Platform ("Stick"), which provides the underlying technology and SMS delivery infrastructure. By enrolling in the Program, you agree to be bound by these Terms. Please read them carefully before participating.

1. About the Program

The Program is a customer loyalty and SMS marketing service operated by Positions Dance Studio. When you enrol, you authorise us to send you promotional and informational text messages, and you may earn and redeem loyalty points at our location(s). The Program is powered by the Stick SMS & Marketing Platform, a third-party technology provider.

Positions Dance Studio is the sole operator of the Program and is independently responsible for all promotions, offers, points values, and rewards available through the Program. Stick's role is limited to providing the platform technology and SMS delivery services and does not constitute an endorsement of or liability for the Merchant's program.

2. Eligibility

To participate in the Program you must:

  • Be a resident of the United States;

  • Be at least 13 years of age;

  • Own or have access to a mobile device capable of receiving SMS text messages; and

  • Provide a valid U.S. mobile telephone number at the time of enrolment.

By enrolling, you represent and warrant that you meet all eligibility requirements. We reserve the right to verify eligibility and to disqualify any participant who does not meet these requirements.

3. How to Enroll

You may enrol in the Program by scanning the QR code displayed at Positions Dance Studio. Scanning the QR code and completing the sign-up process constitutes your express written consent to participate in the Program and to receive SMS text messages from us as described in Section 4 below.

No app download is required. You will receive a confirmation text message after successful enrolment. Your enrolment is specific to this business and its Program.

4. SMS Communications

4.1 Consent to Receive Text Messages

By enrolling in the Program, you expressly consent to receive recurring automated promotional and transactional text messages (SMS and MMS) from Positions Dance Studio at the mobile number you provided. These messages may include, but are not limited to:

  • Promotional offers, discounts, and special events;

  • Loyalty points updates and reward notifications;

  • Operational messages such as confirmation of enrolment and opt-out acknowledgement.

Your consent to receive marketing text messages is not a condition of any purchase from us.

4.2 Message Frequency

Message frequency varies. You may receive up to several messages per week depending on our campaign schedule. Standard message and data rates from your mobile carrier may apply to all messages sent and received.

4.3 How to Opt Out

You may opt out of receiving SMS messages at any time by replying STOP to any message you receive from the Program. You may also opt out by texting STOP to 18336311609. Upon receipt of your opt-out request, we will send a final confirmation text and you will receive no further promotional messages from the Program. You may re-enrol at any time by scanning our QR code again.

4.5 Carrier Liability

We are not liable for delayed or undelivered messages. Message delivery is subject to effective transmission from your mobile carrier. Carriers are not liable for any delays or failures in message delivery.

5. Loyalty Points & Rewards

5.1 Earning Points

Enrolled members may earn loyalty points at Positions Dance Studio as determined by us. Points are credited to your account based on qualifying visits or purchases as we define. Point values, earning rates, and qualifying criteria are set at our sole discretion and may change at any time with or without notice.

5.2 Redeeming Rewards

Points may be redeemed for rewards we offer, including but not limited to discounts, complimentary items, or other promotional benefits. Redemption requirements, minimum point thresholds, and available rewards are subject to change. Rewards have no cash value and are non-transferable unless otherwise specified.

5.3 Points Expiry

Points may expire after a period of inactivity as determined by us. Please enquire at our location for the specific expiry policy. Neither we nor Stick are responsible for any expired, forfeited, or otherwise unavailable points.

5.4 Program Modification or Termination

We reserve the right to modify, suspend, or terminate the Program at any time, including altering point values, rewards, or eligibility requirements. In the event of program termination, accumulated points will not be compensated in cash or any equivalent. Stick reserves the right to modify the platform features that support the Program with reasonable notice.

6. Account & Mobile Number

Your Program account is linked to the mobile telephone number you provided at enrolment. You are responsible for ensuring your mobile number remains accurate and up to date. If you change your mobile number, you must re-enrol using your new number. We are not responsible for any loss of points, rewards, or missed messages resulting from an inaccurate or outdated mobile number.

You may not transfer or assign your account or any accumulated points to another person. Any attempt to transfer points or rewards, or to enrol on behalf of another person without their consent, may result in immediate disqualification from the Program.

7. Prohibited Conduct

You agree that you will not:

  • Provide false, inaccurate, or misleading information during enrolment;

  • Attempt to fraudulently earn points, including by simulating visits or purchases;

  • Use any automated system, bot, or script to interact with the Program;

  • Sell, transfer, or barter points or rewards for cash or other consideration;

  • Enrol on behalf of others without their consent;

  • Use the Program in any way that violates applicable law or these Terms.

Violation of these prohibitions may result in immediate cancellation of your account and forfeiture of any accumulated points and rewards, without compensation.

8. Intellectual Property

All content, branding, software, and materials associated with the Stick platform are the property of Stick SMS & Marketing Platform. All branding, trade names, and materials associated with Positions Dance Studio are the property of Positions Dance Studio. You are granted a limited, non-exclusive, non-transferable licence to access and use the Program solely for your personal, non-commercial purposes. You may not copy, reproduce, modify, distribute, or create derivative works of any Stick or Merchant materials without prior written consent.

9. Disclaimer of Warranties

THE PROGRAM AND ALL RELATED SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE AND STICK DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Program will be uninterrupted, error-free, or free of viruses or other harmful components. Your use of the Program is at your sole risk.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NEITHER WE NOR STICK SHALL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR PARTICIPATION IN THE PROGRAM, INCLUDING BUT NOT LIMITED TO LOSS OF POINTS, UNAVAILABILITY OF REWARDS, OR FAILURE TO RECEIVE SMS MESSAGES.

In no event shall our total liability to you for any claim arising out of or relating to these Terms or the Program exceed one hundred U.S. dollars ($100.00). Some jurisdictions do not allow the exclusion or limitation of certain damages, so the above limitations may not apply to you.

11. Indemnification

You agree to indemnify, defend, and hold harmless Positions Dance Studio, Stick SMS & Marketing Platform, their respective affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of or participation in the Program; (b) your violation of these Terms; or (c) your violation of any applicable law or the rights of a third party.

12. Privacy

Your privacy is important to us. Your personal information, including your mobile telephone number and participation data, is collected and used in accordance with our Privacy Policy, which is incorporated into these Terms by reference. By enrolling in the Program, you acknowledge that you have read and agree to our Privacy Policy.

Your personal information is collected and stored by Stick as technology provider on behalf of Positions Dance Studio. Please review the Privacy Policy for full details on how your information is collected, used, and shared.

13. Changes to These Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated by sending a text message to enrolled participants. Your continued participation in the Program following notice of any change constitutes your acceptance of the revised Terms.

If you do not agree to any revised Terms, your sole remedy is to opt out of the Program by replying STOP to any message, as described in Section 4.3.

14. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of NY, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or the Program shall first be attempted to be resolved through good-faith negotiation. If the parties cannot resolve the dispute informally within thirty (30) days, either party may pursue claims exclusively in the state or federal courts located in NY, and you consent to personal jurisdiction in those courts.

YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION.
